Terms of Service

By accessing or using BidLot (the "Platform"), operated by [Registered Entity Name] ("BidLot", "we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users — buyers, sellers, and visitors.

You must be at least 18 years old and able to enter binding contracts. You are responsible for the accuracy of your account information and for all activity under your account. Bidding requires identity (KYC) verification and a funded, refundable bidding deposit.

Bids placed on the Platform are binding offers to purchase. A refundable bidding deposit must be held before bids can be placed; the deposit is released when you have no active winning bid. Where an auction sets an entry fee or auto-bid fee, those charges are non-refundable as disclosed at the point of payment. Winning a lot creates a binding obligation to complete the purchase within the stated settlement window.

Failure to settle a won lot within the settlement window is a default. Defaults may result in forfeiture of the associated deposit (in whole), recorded strikes against your account, and suspension of bidding privileges, as described at the time of sale. Commission and applicable VAT on forfeited amounts are handled per the platform's published fee schedule.

Sellers warrant that they have the right to sell listed vehicles and that listing information is accurate. Listings are subject to verification, independent inspection, and review before going to auction. BidLot may decline, edit, or remove listings that do not meet platform standards.

Vehicles are sold on an "as-is, where-is" basis except where expressly stated. Decoded specifications and inspection reports are provided to assist your assessment but do not constitute a warranty. Buyers are responsible for satisfying themselves as to condition before bidding. See our condition disclaimer.

Payments are processed through the Platform's supported methods (including M-Pesa). Title transfer and collection arrangements follow successful settlement. Platform commission and VAT are applied as disclosed.

You may not manipulate bidding (including shill bidding), misrepresent vehicles, attempt to circumvent platform fees, or use the Platform for unlawful purposes. Sellers may not bid on their own lots.

To the maximum extent permitted by law, BidLot is not liable for indirect or consequential losses arising from use of the Platform or from any transaction between buyers and sellers. BidLot acts as a marketplace and is not a party to the sale contract unless expressly stated.

We may update these terms; continued use after changes constitutes acceptance. These terms are governed by the laws of Kenya, and disputes are subject to the courts of [Venue]. For privacy practices, see our Privacy Policy.
